Who has more right to be the Imaam for the prayer?

Shaykh Albaany, may Allah have mercy upon him, was asked: Is the leadership for the prayer based upon the best in recitation and in tajweed or for the one who has memorized the most Quraan?

Shaykh albaany, may Allah have mercy upon him, answered:

“The origin is that there is no difference between the best in recitation and having the best tajweed and between the one whom exceeds the rest of the people in his memorization of the Quraan due to the reason that memorization of the Quraan technically means that it is coinciding with the way it has been revealed. Reciting the Quraan in accordance to how it has been revealed requires that one preserves the etiquettes of the recitation that which been mentioned by the scholars of Tajweed in their books. So if there is a man whom exceeds everyone else in his memorization of the Quraan but he recites incorrectly then the one whom has memorized less than him while he recites correctly is to be brought forward to be the imaam because the recitation with tajweed is intended by the statement of the Prophet, alayhi as salaatu wa as salaam: the people are to be lead by the best of them in the recitation of the Quraan”.

Question:

Is there proof from the Book or the Sunnah or action of the Prophet (peace and blessing upon him) for shaking hands when one enters upon those that are sitting? May Allah reward you with good.
Answer:

I don’t know anything of this kind from the Sunnah, for this reason it is not appropriate for you to do so. Some people when they enter a gathering they begin with the handshake from the first person to the last person and this is not legislated from what I know, and shaking hands is only for when meeting one another, as for when entering the gathering, then it is not from the manhaj of the Messenger (peace and blessing upon him or his companions) that they would do that. The Messenger (peace and blessing upon him would come and sit at the end of the majlis (sitting room) and we never heard also that if he sat at the end of the majlis that they would stand up and shake his hand, so shaking hands in this manner is not legislated. I asked about this to those who we rely upon from our Shaykhs, so they said we do not know for this an origin in the sunnah…

Ruling on the prayer of the one who drags his garment, answered by Shaykh Muqbil Al Waadi’ee rahimahullah

Question:

Is the prayer of the ‘musbil’ (one that drags his garment) invalid, and what is the condition of the hadeeth: “Allah does not accept the prayer of the musbil”?

Answer:

‘Isbal’ (dragging the garment) is impermissible, and the prayer is not invalid, it is impermissible in prayer and other than it, as for that hadeeth (which the questioner mentioned) then what I remember of it and it was a long time ago, it is from the report of Abee Ja’far and he is unknown so the hadeeth is not authentic. But ‘isbal’ itself it impermissible, the Prophet, may peace and blessings be upon him and his family said: “Allah will not look to the one who drags his garment arrogantly”, and he said, “Beware of dragging your garment for verily it is from arrogance”. And the hadeeth, “There are three types of people Allah will not speak to, and He will not look at, and for them is a painful punishment”, from them, “musbil”.

What is the ruling on swearing by saying: by the Right of the Quran and by the Right of the Womb (ie. Kinship)?

Answer:
If the intent is by the revealed Quranic verses then this is an attribute from the attributes of Allah and it is permissible to swear by this. And if the intent is by the paper, and the ink, and the book covers; then this is considered swearing by other than Allah, and is not permissible. And also like that (swearing by the Right of the Qur’an) is swearing by the Right of the Womb. The Messenger, may Allah send blessings and peace upon him and his family, said: “Whomsoever must swear, then swear by Allah or remain silent”

Shaikh Ibn ul-‘Uthaymeen rahimahullah was asked:

Question: If we know that the one asking for money asks in order to purchase cigarettes to smoke. What is the ruling?

To which the Shaikh rahimahullah answered:  “We give him in food”.

He explained that voluntary charity does not have to be given in money in the first place and it can be given in anything that benefits the one in need etc. fruits. So if a person is giving voluntary charity and this poor person wants to buy cigarettes, then it is allowed to give him food that will benefit instead, or clothing, or what he needs. That is better than giving him dirhams (money)

Question: Nowadays, a man sells [a product] after having the receipt/invoice and the product is in the warehouse. Likewise, the product is sold and bought while it is still in the same warehouse.

Answer: “This is not allowed. It opposes these Ahaadith*. Verily selling occurs when the buyer purchases it [the product] then owns it. As for selling it before owning it, then that is not for him”.

*One of the Ahaadith the Shaikh is referring to is the following:

عَنْ حَكِيمِ بْنِ حِزَامٍ، قَالَ قُلْتُ يَا رَسُولَ اللَّهِ الرَّجُلُ يَسْأَلُنِي الْبَيْعَ وَلَيْسَ عِنْدِي أَفَأَبِيعُهُ قَالَ ‏ “‏ لاَ تَبِعْ مَا لَيْسَ عِنْدَكَ

It was narrated that Hakim bin Hizam said:

“I said: ‘O Messenger of Allah, a man is asking me to sell him something that I do not possess; Shall I sell it to him?’ He said: ‘Do not sell what is not with you.

Question: May Allah be good to you, this questioner from France says: there is a man who entered Islam and he does not have a father because his father and mother were not married [i.e. he is an illegitimate child]. So is it allowed for this Muslim to name himself the son of Adam or son of Ibrahim?

Answer: “It is allowed for him. He can name himself with any name”.

Question: Is social security/assistance allowed for the one who does not have a need for it?

Answer: “That which we know is that the government, may Allah facilitate for them, gives social security/assistance to the poor who do not have anything and who meet the conditions for taking it. And it is not for him to lie. Verily the one who is from its people can take social assistance and meets the desired conditions. As for the one who lies and claims to be poor or she claims that she does not have a husband and she has a husband and what resembles that, then he should not take that. The conclusion is that it is not allowed to take social assistance except the one who meets the conditions which the government has placed. This is obligatory. It is obligatory to fear Allah and be cautious of taking what is not allowed for him. And in Allah aid is sought”.

Question: Is it allowed to broadcast the Jummah Khutbah on the women’s section with both the voice and image of the Khateeb?

Answer: “There is no need for this. [Is] the people’s affair showing pictures and [the women] looking at the men? This is not necessary. The women come to the masjid, stay away from the men, and have the picture of men [displayed] in their section as if they are with the men? This is a great mistake”.

Throwing Harm in the Street (Littering)

The Prohibition of Littering

Ibn ul-’Uthaymeen rahimahullah:

“the conclusion is that everything that harms should be removed from the street. You will be rewarded for that deed. Therefore, if removing harm the street is an act of charity,then throwing harm in the street is a sin. Amongst those who are sinful are those who throw their garbage in the middle of the sin…” [Sharh Riyaadul-Saliheen (1/290) no. 248]

Shaikh Abdul-Muhsin al-’Abbad was asked:

Question: What is the ruling on throwing harm in the street?

Answer: “No doubt it is sinful for him to throw harm instead of removing it from the street. This is similar to one who urinates in the street. However his statement sallahu alayhi wa salam: “Beware of the two sources of curses” is intended to mean the one who relieves himself in the street or the shade of the people which they use to shade” [Sharh Sunan Abi Dawood no. 594]

The danger of Throwing Harm in the Street

سَعْدُ بْنُ أَبِي وَقَّاصٍ، فَقَالَ: ” إِيَّاكُمْ وَالْمَلَاعِنَ، أَنْ يَقْذِفَ أَحَدُكُمْ أَذَاهُ فِي الطَّرِيقِ، فَلَا يَمُرُّ أَحَدٌ فِي الطَّرِيقِ إِلَّا قَالَ: لَعَنَ اللَّهُ مَنْ فَعَلَ هَذَا

Sa’d ibn Abi Waqqas said: “Beware of action that will incur cursing: that a person throw his garbage in the street. So no one passes the street except he says: may Allah curse the one who did this” [al-Musaawi ul-Akhlaaq of Kharaaiti no. 800 with the a Saheeh chain ]

Reward of Removing Something Harmful From the Street

The Prophet sallahu alayhi wa salam said:

وتميط الأذى عن الطريق صدقة

Removing harmful things from the way is charity

[Agreed Upon]

And he said:

وإماطة الأذى عن الطريق صدقة أو قال : ” صلاة

And removing something harmful from the street is charity or prayer

[Reported by al-Bazzar (1/438) and al-Haythami said in al-Majma’: reported by Abu Ya’la, Bazzar, and Tabarani in al-Kabir and Sagheer with something similar. He increased in his narration with: “All of that is compensated for by two rakats of Duha. The narrators of Abu Ya’la are the narrators of the Saheeh]

The Ruling on Removing Something Harmful From the Street

Shaikh Abdul-Muhsin al-’Abbad hafidhuhallah was asked:

Question: Removing something harmful from the street, is it obligatory or recommended?

Answer: “That which I see is that it is obligatory because the people will be harmed by it” [Sharh Sunan Abi Dawood no. 594]

What to remove from the street

Shaikh Ibn ul-‘Uthaymeen rahimahullah said:

“If you find in the street a rock or glass or thorns or other than that, then remove it, then that is from Imaan. Even cars which are parked in the middle of the street and make it narrow for the people. So they harm the people in the street and removing that is from Imaan” [Sharh Riyaadh us-Saliheen (1/736)]

What if you cannot remove it?

Shaikh Ibn ul-’Uthaymeen said: “so like this it is necessary to remove the harm from the street. If he is not able to, like there is a big rock or piles of sand or the likes, then let him convey it to the Municipality, for example, because they are responsible for this. So let him convey it to them so that he can be from those who help in righteousness and piety” [Sharh Riyaadh-us-Saliheen (1/736)]

Removing Something Harmful From the Street in a Non-Muslim Land

Question: The one who is in the lands of disbelief, does he remove something harmful from the street?

Answer: “Yes. He removes something harmful from the street even if he is the lands of disbelief” [Sharh Sunan Abi Dawood no. 594]

The One who Throws Harm in the Streets is Deficient in Imaan

Question: “Is it allowed to say that the one who throws something harmful in the street is deficient in Imaan?

Answer: “Yes, not doubt he is deficient in Iman because this is abuse and harm to the people” [Sharh Sunan Abi Dawood no. 594]
